Hi! My daughter had to do this to try to immigrate back to Canada. I would need alot of information to help you. I wrote the letter for her. If you can give me all the circumstances and the whys and need to I will try to help. But this is very complicated and often you may need a lawyer to help. But I will try if you can give me a detailed account of the history of your problem. And I mean detailed. I had to write a very complex letter so that they accepted her. I'm sure this will be close to the same.

My sister was with this gentlemen that got a girl pregnant underage and lived in the United States before this happened for 14 years he was a lawful permanant residence.   Girl's mother threatened to have him put in jail for satutary rape if he did not marry her daughter. My sister met him after he was with her, and then all this stuff starting happening and she tried to help him by obtaining a lawyer, which did not help much, this lawyer told him to plea guilty which he served 14 months because he had over stayed a visa due to being held without bail. Plea bargain 1 year times served. This lawyer told him that it wasn't worth going to trial because he would be remove regardless. Don't know where the visa came from because he was a lawful permanent resident of the United States. Then was taken by immigration, and after a month and a half he was driven to Canadian border in Quebec, does not know if he was removed or deported. He is limited to reading English when told to find something by Authority of law he does so, example while in immigration holding he was told he had to sign something, and later finding out he gave up his rights to see an immigration judge. Another example: While on his way to Michigan was told at border that he had warrant for his arrest due to charges with girl for sexual assault later found out papers' he signed at border with no translater in his native language Italian but translated in Spanish, he had signed his green card to be paroled for a 3 month visa to face charges in Massachusetts. It seems to be they took his green card before his criminal case was finished.

After speaking to several immigration lawyers he spoke to the American Embersy in Rome who advised them to reapply for a visa, where he must start all over again. My sister did the fiance visa, interview was approved all procedures taken, finger prints, doctors physical, providing all evidence, then last minute on one of the forms ask if ever been convicted of criminal offense, they answer truthfully yes, later asked why? After showing he was charged was sexual assault of a minor was treated, like judging a book without reading the entry. Another words they did not want to here anything, interview was over.... They told her she needed to fill out a form 212 a 601 form with appropiate fees, and letter showing extreme hardship. And she has 1 year to do this or his paper work is disposed of, so after they took her money and making her think they had a chance to be together. Please help her!!!!! Thank you so much she really needs to know which way to go. Like I said she has a son in the United States, pregnant by this man also, which he has 3 daughters in Michagan, they just want to be a family. How should she write a letter of extreme hardship, without being let done again. She is so depressed she keeps saying it's hopeless, but I keep telling her to have faith... Thank you so very much for your time I just want my sister to smile again....Gina
