Hi ,Im in waco texas My father passed away 4 years ago ,He had a will that was never read.Their were 4 plots at the cemeatery that my father had bought years before,with my mom they are both buried there. my stepmother is now tryin to sell them,my dad always told me and my sister that the other two plots were ours can I stop my stepmom from selling the 2 polts.thanks a million for you advice in advance

these plots were bought by my mother and father many many yers b4 my mothers death. I have no idea if they were in the will, and i have no idea if the will was probated. I just want to know what i can do to stop my stepmother from selling them,,,I was told all my life as a child that tey belong to me and my sister and my stephmother knows this

you need to establish ownership for that property to be able stop selling.

You may go to the cemetery administration and find who owns plots. It sounds like your stepmother is the owner - you just need to confirm that. You may also want to inform the cemetery administration (in writing!) that you are objecting the sale.

The second thing you might want to do - go to the probate court in the county where your father lived at the time he passed away and find out if his will was probated or the ownership on his estate was transfered any other way.

If the will was not probated - you need to find the Will and find out why it was not probated.

You also need to be prepared to answer the question - why after your father died you did not requested the ownership for the plot.

well i had always been told by my father that the plots were bought for me my sister and my mom and dad.I never thought my stepmother would ever do something like this.How do i get a copy of my dads will.How do i go about getting legal action started, where the sale will be halted till I can go before a judge?

How do I obtain a copy of the will? If it was not probated and she refuses to give me one.If i do find out she has established ownership of the property can I sue her for ownership being that im his oldest living child
