My husband has a son with an ex-girlfriend and they have never been to court before for anything. My husband hasn't seen his son in almost 7 years except 1 day this year when his 8 year old finally found out he was his dad. His mom wants us to give up his rights and we want to but I am not sure how its done or what forms I would need. It is hard since we live over 6 hours away from the child. He resides in Texas and us in Oklahoma

Hello--

Your husband will have to sign a voluntary relinquishment of rights to the child. He may be able to do this with your state's child welfare department. He may need to notify the Texas child welfare agency so they can take his termination of rights on paper and possibly have to file it with the Texas court.

Reply to Susan Roberts's Post: Where do I get the paper to do that. This matter has gotten so big because 8 months after the day we saw him she sends us a nasty email stating she is getting us for child support and she already filed the papers with the Texas State Attorney even though my husband has no rights. Then when we tell her we want to give up the rights she agrees but will not call and cancel what she has started until she makes sure this is "binding" as she says. Are there possible forms on the Internet that I can download. This is beyond us. I know there are some forms you can get notorized and some have to be done by an attorney. Do you know if I will end up having to get an attorney?
