my husband works for usa trucking and they made a mistake and he was not paid this week. they are saying we have to wait until next week. i now have 7 overdraft fees can they do this?

my husband works for usa trucking, pay is direct deposited on Mondays, they made a mistake and did not pay him and will not pay again until monday. I now have 7 overdraft fees. can they hold his pay and since the checks came back due their error can we make them pay for them. this has really hurt us.

I recommend that you contact the Texas Department Of Labor -- Employee Hotline at: 800-832-2829 to find out what your husband's rights and options are in this situation. Specifically ask them if your husband can file a wage complaint.

Although it would be illegal for them to fire him for filing a complaint -- that is not to say that it could not happen.

Still, I think that you should contact the Texas Labor Department -- they will be able to tell you if the company's actions are out of line. If so, they should also be able to advise you regarding your understandable concern about dismissal, if a complaint is filed.
