Officers of the company can, depending on the nature of their relationship to the company, be exempted from worker's compensation coverage but must of course provide insurance for all workers regardless of their own exempt status.

Simply that some officers may not be covered by worker's compensation. At my law office, we are a professional corporation and the partners are exempt and not covered by worker's compensation. The associate attorney and all other administrative staff are covered. We were exempted from being covered. Depending on the role and nature of the officers particpation in the business you are questioning, they may also not be covered by worker's compensation. Your question didn't provide a lot of detail, simply whether or not the officers MUST HAVE THIS INSURANCE under New York law. I am simply advising that they do NOT always have to have the worker's compensation, but there would have been a determination early on that they were exempt and not covered. Hope that helps.
