My ex & I were divorced 8 or 9 years ago. I left her with the house, and pick up truck & I was allowed my 401k retirement account. The attrorneys agreed to $400.00/mo. spousal support to her for life. We were married for 17 1/2 years, no kids. I am remarried, she is not. she is not working. I plan to retire in 1-1/2 years & am wondering if there is a way out of this. My income will obviously drop dramatically when I retire @ age 62.

Oregon does allow you to petition the court to terminate or reduce your spousal support obligations whenever there is a "substantial change in the circumstances", however you cannot petition for that now. You would have to wait until you are actually retired to make the request; because at the point of retirement your income will be drastically reduced. At the present time, nothing has changed, so your obligations remain as agreed to in your divorce papers. Re-marriage from the paying spouse is not a factor to reduce spousal support unless your current situation is such that you can no longer afford paying the $400.00/month. Again the court is looking for a substantial change in circumstances which warrant a reduction of elimination of the support obligations. If you were to petition now, you will need to produce evidence of how your circumstances have changed. Since you have one year and a half before retirement, that evidence would be premature.
