My boyfriend lived in a condo for 1 year with a 1 year lease. He had an inventory checklist filled out about the damages the place had, returned it, but doesn't have a copy of it. He had a $1300 sec dep, $300 of that was nonrefundable cleaning dep. He doesn't have a copy of his 30 day notice, which he both emailed and mailed to them. 2 weeks after he moved out he called them, asking for his money, they said it would take at least a month. So he called back 2 weeks later, again, they said they had a check ready for him, which needed to be mailed out. He wanted to pick it up, the lady said it needed to be signed before that, but the person who supposed to sign it wasn't in for a couple of days. After a few calls he was told he would get like $500 back. They used his money for painting and such. The lady who is in charge wouldn't even come to the phone. He feels they hold his money back without a good reason. He wants to take a legal action. Any website I could look for help? Thank you!

Hi Andika,

Due to the amount of monies involved there is no point in hiring an attorney for this. It would be in the best interest of your boyfriend to go to the courthouse that is located in the district that the condo is located in and file a petition for small claims court.

This fee ranges from 20.00 to 40.00 depending on the circuit and court costs. When he arrives they will simply give him a form to fill out and he will write down the events that have taken place.

He can also have all of this paperwork subpoenaed when he files his petition. There is usually a small charge for this also.

In essence for less than (approx.) 100.00 he can take care of this himself in the small claims division. These cases are also expedited much quicker than the cases that are heard in the appellate courts.

Good Luck to you in this, he has a case.

Reply to Terri's Post: I went online for Nevada court information and it keeps sending me to a California based court info website, does this mean they have the same laws for Nevada residents as in CA? i.e. in Ca your landlord has to send you either the full amount of sec depo to you in 21 days of moving out, or an itemized list of damages and how much they would cost. His walls were not painted when he moved in, he gave the place back as it was before moving in. Can you give me a website where I could find info about laws regarding to security deposits, charges and all that? Because if the same applies to NV as to CA he can send them a letter saying he is asking for his money back, nicely or he is going to file a small claim. That CA court info site helps you to write a letter to the landlord. Can he just use that first, before filing a small claim?
