recovery company is taking us to small claims court but we feel statute of limitations is up do we need a lawyer and can they freeze our bank account

we have not made a payment since aug of 2003
the claim recovery agency says we made one in june of 2004 and says he dose not have to have proof that it was made that he can just go by my credit report and the statue limitation is not up according to him

In the end, it will be entireley up to a Judge to determine the credibility of the parties with respect to when the last payment may have been made. I would certainly pull a copy of your credit report and cancelled checks for 2004 and present them as an exhibit if no payment on the debt was made.
