I am a freelance photographer who lives in NYC. I have an agent in Florida who got me three jobs shooting for Kmart. I shot the jobs, the client was very happy with the film. I billed my agent who in turn bills the client, Kmart.
It has been severla months and my agent still has not paid me. I have sent many e-mails ad have called several times. I have $1500.00 outstanding for 245 days, another $1500.00 outstanding for 167 days and $4800.00 outstanding for 90 days. I don't know what to do. I am in debt know to my credit cards and I need to be paid and I want interest if possible. I have to pay interest on the money I had to put on my credit card in order to get by till they pay me. Can you offer me any help in this matter?

Thank you for requesting my assistance in this matter.

First, I suggest, you write a letter (not an email as there is no proof of acceptance) to you agent demanding payment

Dear

It has been (how long) since the assignment for Kmart wherein you received payment in the amount of (dollar amount). According to our contract, your percentage is (whatever it is). Therefore I am due (amount due you). I am making demand that these monies be paid to me within 5 days of receipt of this letter or I will have no other option but to file a claim against you.

Send this letter via certified mail with a return receipt, which is your proof that the letter was received. When you get the receipt back - wait the five days from when the receipt shows it was received and then file a claim in the NY Small Claims Court.
