What could, or would happen to someone who loaned their social security number to an undocumented friend for a year in 2004? I know a legal resident who loaned their social security number to an undocumented friend for a year in 2004. Her husband explained that it was illegal and that he would end up paying the taxes on the income earned. What penalties could this person faced?

Hello,

There are good reasons why most people try to keep their SS numbers private. One is that if someone illegally uses that number to get a job, their income earned will likely be attributed to you. There is a very good possibility that your fried could receive a letter from the IRS asking about all this unreported income.

This would put her in the very uncomfortable position of either paying the money or having to report her undocumented friend. The undocumented worker could also use the number to take out credit cards or do other things that could end up coming back against the friend.

Also, aiding an illegal alien to help them stay in the country and illegally obtain a job is a felony under federal law, punishable by up to five years in prison. You can read the law here:

While this maximium penalty would probably not be given in this case, criminal charges could be a possibility.
