In nj violated a restraining order that was not yet served

My boyfriend violated a restraining order in Nj but he was not served with it. I dropped the restraining order about 2 days after this.

the restraining order was granted on 9/28/07... he violated it without knowing about it on 9/29/07. he was never served a restraining order. i cancelled it on 10/2/07.

He has an arraignment on 10/25 for this. Do you think he could be charged with violating the restraining order under the circumstances, or do you think its best to go in with a lawyer for the 25th?
