I had asked about a court hearing regarding a temporary peace order. My ex-boyfriend wrote on the petition that I assaulted him, stalked him, and that he fears serious injury from me. One attorney said to appear in court and say, "I agree to consent." Another attorney said to "agree to consent without finding." (to the peace order for 6 months). I am afraid that if I just say that I agree to consent, I will be saying I am guilty of his allegations. Is that correct? Should I have an attorney with me? Can I say "without findings" and feel secure in that without having an attorney present? Thank you very much.

This is you hearing to SHOW CAUSE as to why the Peace Order should NOT become permanent. If you do not show up, it will be a permanent order by default. If you show up you want to explain what happened, if anything. Check the dates that are listed in the affidavit so you can bring witnesses, if you want, as to where you were and what you were doing that day and time. If you say nothing, the order will be granted and it will go on your record. Many times this hinders employment, leasing an apartment, etc.

I do not suggest you go in an say I did it - unless you can prove that whatever it is being alleged was done in some kind of self defense.

If you say anything else, you will be admitting guilt. If you did not do it, say that. Do not look at the Petitioner, stay focused on the judge and do not speak until asked a question by the judge.

You do not want this Temporary Order to made permanent
