I was discharged on 3/3/08 my employer promised in writing 2 months & 1 week of severance pay, to date I have not received a thing. what are my options?

I suggest you write the employer a letter enclosing a copy of the severance agreement -

Dear

I am inquiring as to when the payments as determined and agreed upon as evidenced in the enclosed copy of the severance agreement are going to be made. According to the agreement these payments were to be made (if that is the case state what the agreement provides for). Please provide me with the details as to when I can expect these payments or provide me with the payments as agreed immediately.

If you need anything further from me to move this process forward, please let me know. Otherwise, I will expect payment. Your failure to contact me and/or uphold your end of this contract may result in legal action against you.

Sign and then mail it via Certified Mail with a return receipt requested - give it 5 days after the receipt of the letter and then you may want to consult with a local attorney to decide if you need to file a law suit or if the attorney wants to send a letter first.

Keep a copy of the letter, of course, with the receipt of acceptance you will get back from the Post Office. This will show that you made a good faith effort to settle the matter if it should go to court and that this was received as evidenced by the return receipt.

Reply to Michelle's Post: He did send me a release of liability letter, which i did sign and send back to him with a disclaimer on it that i intended the severance to be paid according to our written agreement which was attached. that was 3 weeks ago. I have only received excuses why it hasn't been paid yet. I know that money is not a problem for him.

Well, you need to send the letter before you go to court, if it comes to that. So when you have really run out of patience with him - because we know these matters take time - I suggest you send the letter. You could give it 2 more weeks and then send the letter. That would be a 5 week total of when you last had correspondence with him about it.

just out of curiosity, he told me that even though I was the senior employee next to him, I wasn't fitting in with the 5 new employees all in their 20's that he had hired in Dec 07 and he didn't think I would be able to make the change. I am 43. I did recieve a $2500 xmas bonus from him for outstanding work. what do you think?

Well, if you suspect age discrimination - you can contact the EEOC - and speak with someone there who can investigate your claim. If you are 43 you fit the criteria. You can CLICK HERE for that information, if you want to go that route. Keep in mind, that you have accepted a severance package and that could be "hush" money so you wont take him to the EEOC or to make you feel better about being discharged.
