Brian breeds pit bulls. Brian's friend, Steve, comes over to visit Brian one day and wanders into the backyard where the pit bulls stay. One of the pit bulls attacks Steve, and Steve suffers multiple injuries. Brian had the pit bulls leashed and properly confined in his backyard. Under what theory may Steve successfully file suit against Brian? Why?

Steve could sue Brian due to his "negligence" in knowingly keeping vicious animals, whether they were leashed and properly confined or not. Brian allowed Steve to visit and wander his "property" and may be "tortiously" liable for Steve's injuries.

Steve could sue for damages and would be able to obtain a judgment against Brian's property insurance company. If Brian did not have any insurance, specifically due to these dogs, then Brian would have further exposure for negligence.
