Hi,

You have 2 years to sue the person you hit you. The suit is against the person not the company, although the company will handle the claim and assign an attorney to defend its insured if you actually bring suit. If it's just property damage, make the claim against the company immediately so they can inspect the car. You can probably settle it while you are away on the phone. Hope the family issues get resolved. Good luck.
