(Not a Legal Question?)

Fraudulent signature
Sent to Legal Experts April 20 04:14 PM

I recieve an injectable medicine monthly from Tel-Drugs to be delivered by U.P.S. service. It is a REQUIRED signature item. The last delivery was left in the apartment building lobby by the driver. I DID NOT sign for the medication. Yet my insurance company tells me that there was one. Is this fraudulent?

Probably not a fraud.... although the person may have pretended to be you, it is most likely that they did not. An important part of Fraud is the person does it to gain something, or an advantage other another person. If the medicine was left for you, it was not done in a fraudulent manner.

I would call UPS and talk to them about it. Review their policy about signatures. Since the package was in your building, their policy may say that others may sign for it as long as they show their ID. Stress to them that you expect privacy to what is delivered to you, and they may have a way of notating that no one else may sign for you.

If someone signed for the medicine AND it was stolen then yes, you've got a case for fraud.

Best of luck to you. Please don't forget to "Accept" my answer if you found it to be helpful.
