My neighbor and I share a privacy fence separating our properties. I am willing to fix the entire fence at no cost to the neighbor, yet the neighbor refuses to let it happen. He states that the fence is on his property and is his. If I want to build a fence I may do so on my property line. What do I do?

Already Tried:
letter to neighbor stating intent and plan to have survey put flags up tomorrow to find property lines. Do you think we need a survey drawing?

Dear Customer (name blocked for privacy) - Assuming you are permitted by city code to build a fence on your property then I would do so. I would also recommend having a survey completed to be certain where the line is located. If the existing fence happens to be on your property you would be allowed to tear it down. If not then you will have to build on your own property.

should I get a survey with a diagram of my lot, or will flag lines suffice?

Just so you know where the property line is actually located. I would think that the flag lines would suffice for your purpose since a diagram is just a drawing and does not actually mark the exact spot such as posts or flags.
