What are my rights as a tenant when my landlord wants me to move and I can''t find suitable housing? He has not done anything officially through a magistrate yet. How long must he give me to find a place. Also in a few weeks I will undergo surgery for 2 knee replacements. I am still employed and paying the rent although sometimes a bit late

I had a one year lease when I moved in August of 04 I am now just month to month as we never renewed the lease I figured I could trust this man

I am not in California. I am in Pennsylvania and I'm sure the laws are different here especially in the winter

Sorry about that. For some reason I was certain I read California.

I've reviewed the Pennsylvania code and the rules for eviction in Pennsylvania are as follows:

-On a month-to-month lease the landlord would still be able to evict you regardless of what situation you will be in post-eviction.

-The landlord must give at least 30 days notice indicating by when you must vacate the premises to avoid court-ordered removal.

-A complaint will then be filed with the court and a hearing set. At the hearing the judge will decide if the eviction is valid. As a month-to-month tenant it is almost certain the eviction will be upheld.

-You will then be given 15 days to leave the premises. If you don't leave an Order of Possession will be issued after those 15 days. This will give you yet another 15 days to leave. If you fail to leave the authorities will forcibly remove you after these 15 days.

All in all, from the moment you are notified of eviction to the day they can forcibly remove you the process in Pennsylvania takes roughly 65 days. So, if you have yet to be notified of what day you must leave, you are guaranteed that it will take at least 2 months before you will be forcibly removed.
