My former wife was granted a judgement against me on Augest

My former wife was granted a judgement against me on Augest 21, 1997, which she allowed to expire. I just received a notice she has renewed this judgement through a paralegal on August 20, 2007. Am I liable for this renewed judgement?

The statute of limitation on Domestic Judgment in California is 10 years and it may be renewed for additional 10 years.

Yes - this renewed judgment is enforceable. You also may be charged the interest for the judgment - up to 10% or contractual amount.

You may negotiate with the creditor - your ex-spouse - payment options.

  • you may pay in full;
  • you both may agree to lower the amount if you pay in full.
  • you may set a payment plan for installment payments - still need an agreement from both parties
  • the creditor may turn the judgment to collectors or sell it to third party
  • the creditor or collectors may enforce the judgment - start garnishment from your wages, accounts or put lien on your properties.
