I have a civil case pending in AZ the judge ordered the opposing counsel to disclose over 4 months ago. I filed a motion for rendering of a default judgment & for hearing to determine damages. The defendants attorney responded to my motion & in his response he ignores the judges order & answered misrepresented statements (lying). I have a recorded telephone call between there paralegal & I that could prove this. I inquired on tape recording laws at a glance & there is no problem the thing is that I am staying in CA & what I read could be a problem w/ interstate calling or should I ignore the attorneys lying answers & focus on important issues on not obeying the judges order? ( I am pro se) please need help. Susan

It seems that the bigger issue is that the attorney is in contempt of court. If the order gave a specific time frame counsel had to disclose and he has not complied, then you could not only have grounds for a default judgment, but that attorney could face fines from the court. Go HERE and read under Chapter 7, Article 4.
