I had to file personal and business bankruptacy in August 2006. In December 2006 I received a letter from my lawyer that said my personal debts were discharged. I have yet to receive a letter from my bankruptcy Trustee stating my business bills are discharged. What I want to know is this, Am I supposed to receive such a letter or some sort of document informing me that my business bankruptcy is over. My Trustee''s paralegal told me that I have done everything I needed to do. My last legal meeting I had to write the Trustee a check for $15,000, of which they were paid $4,000. There was lots of money left owing to my business and the Trustee has collected some of the amount. Could this be the hold up? I have called the Trustee''s office to speak to the paralegal and she never returns my calls. My lawyer plain told me that if I did not want to settle paying the $15,000, then I''d have to start paying him by the hour. So I can''t call him anmore. I am senior citizen.

Sara:

Corporate bankruptcies do not get a discharge like consumer bankruptcies. They just get a "case closed" and that's it.

If the trustee is still holding or collecting assets of the corporation to give creditors, then yes this could hold up the case closing for some time, even years. However, do not expect to get a discharge like you did in the consumer case since they won't send one.

I hope this helps and a positive feedback is always appreciated if this was useful to you.
