I have a brother who can't pay an increased ...

I have a brother who can't pay an increased probation of $126 since the arrival of a new probation officer. His previous PO had him paying $20 per month. He is also disabled and on a fixed income and doesn't have enough money to pay this new fee. I'm his payee, over his money, and will be at his court hearing Tuesday. Yes, he has to be accountable for past choices, but I'm furious about why he was incarcerated and my numberw were left in his records to be contacted if the PO's needed something that my brother wasn't/couldn't provide. Why didn't thet just call me?! I will have all the documents related to his monthly expenses in court. What are my possible options and strategies of attack in court on Tuesday?!!

These fees can be waived - - most times when the offender is disabled this is done - but a request needs to be made to the officer who in turn makes a request to the court - you should have documentation of his income, liabilities and disabiltiy.

And now he is being violated on the technicality of not paying fees - in court you let the judge know his health situation and have the documents as stated above - ask that the be waived or at the least reduced - and then a manageable monthly payment established. The PO should be totally ashamed for bringing such a violation forward. The judge will see that.
