I had responsibility of answering an email box. I researched billing issues, audited accts and issued crd/dbt adj up to $200,000. My job title as a serv rep was same as rest of office. I had this position for 5 yrs. The work frm email box was sent to home office. They closed it as it was to complex. However, after a few months, the company established another email box for data errors. They assigned two individuals (serv reps) to issue orders to correct data errors. Only SIMPLE requests were to be sent to the email box. I later found out that these two were receiving rate differential pay for handling these simple corrections. I never received any rate differential pay for handling COMPLEX issues. I filled a grievance in December with my union. However, I cannot get the stewart to reply to my requests for status or return my calls. I was informed via another stewart that my request was denied stating I did not have the skill codes that the others had. Do I have any legal claims?

Regarding the reply, not sure my circumstances are totally understood. My coworkers do not have more skill codes. I have taken continued job course related our field which earns skill codes upon completion. They have not take one course additional course. They do not have more codes than I. That is not a valid reply for this situation. We have the same job titles. The only time skill codes come into consideration is when a job is offered to ALL EMPLOYEES COMPANY WIDE. The position must be posted for all to apply and based on skill codes the most qualified for the outlined posted position will be offered the position. These positions were assigned, not applied for. Neither positions had or required additional qualifications or training. We already qualify for service rep. That is the position we all held.

Apologies for not fully understanding. I read where you said you were told you did not possess the skills as your colleagues - so let me ask you why do you think then that they are getting more money than you?

My personal opinion, one of the two employees is extremely intelligent and her abilites to comprehend issues are valuable. However, she will not give an inch to assist outside of the listed job duties unless she is paid a rate difference. She will not even answer a question. Its a rare occasion if she does. I now understand why this responsibility was not offered to me (even though both employees asked why dont they have me work the box because this is the type of work Ive been doing). Had they offered this position to me and offered to pay the rate difference (if RD is offered to one it must be offered to both), I would have questioned why I had not been paid a rate difference for what I had been doing for five years. Why would they pay me for doing something less complicated from what I had been doing? It is obvious they did not want me to question it. The email box that my coworkers handled for corrects was strickly for SIMPLE corrections (cor address, typo errors, etc.)which is the instructions sent out to the office. Any complicated issues was sent to the management to correct.The box I handled was very complicated. After attempting to train an employee in home office for over 1 month of assistance, it was decided the email box would be closed. I find it odd that my union rep has never contacted me since I filed my grievence with him. I understood that if the company decision was not acceptable then the issue would go to mediation. I have no idea how my grievence was handled. Also, wondering if there is a time limitation for any claims if valid?
