CAN I SUE THIS YOYO FOR MALPRACTICE

I HAVE BEEN ON WORKMANS COMP. THEY DECIDED IT WAS TIME TO BOOT ME OFF AGAIN LAST OCT. MADE MY APPOINTMENT WITH MY LAWYER IN OCT. WENT IN HE TOOK ALL MY STATEMENTS AND STATED THIS WOULD GO TO THE FRONT OF THE CASES SEEING IT HAS BEEN AN ON GOING CASE.
I CALLED NUMEROUS TIMES SINCE TO GIVE THEM UPDATES ON MY MEDICAL, ETC. MOST OF THE TIME I HAD TO TALK TO THE LEGAL SECRETARY. I ASKED HER NUMEROUS TIMES AS TO THE PROGRESS WITH THE CASE--STATED THAT WE WERE WAITING FOR COURT DATES. I TRIED REACHING THE LAWYER IN LATE DEC. HE WAS GONE TILL JAN 8, 2007. CALLED THAT WEEK HE DID NOT RETURN CALLS. CALLED THE FOLLOWING WEEK AMD HE WAS GONE FOR ANOTHER 2 WEEKS. LEFT MESSAGES--NO RESPONSES BACK. I THEN CALLED WORKMANS COMP BUREAU THEY STATED THAT NOTHING AT THAT TIME HAD BEEN FILED FOR ANY MEDIATION.
CONTACTED THE LAWYER--HE HAD MORE EXCUSES THAN ONE COULD COUNT--BUT WOULD GET ON IT ASAP.TO DATE NOTHING.
WHAT ARE MY CHANCES IN COURT SUING HIM FOR MALPRACTICE???
