My Father passed away and his remains cremated by my stepmother,against his wishes to be buried. I was wondering if I had any legal claims to his remains, now or in the event my stepmother passes on? I just want to amend her wrong doings, and put my father to rest were he requested.

My father and stepmother were married since 1989.

Your Stepmother would have been the one in line to decide what to do with your deceased fathers remains. She could do with them as she pleased as she was the legal spouse. She can now do with the remains as she sees fit. Whether by scattering them or by burial. If she intends to retain them then it would be in your best interest to speak with her and get in writing a signed and notarized statement stating that at her death his remains will go to you.

But at this time she does have full legal control of them and can do as she pleases.

Reply to 4ren6's Post: I understand that it is my stepmothers intention to have my fathers remains buried with her upon her death. However do I any legal say in the matter after her death and before she is put to rest with my fathers remains? I dont have any kind of relationship with that side of the family since my father's untimely death, so talking to her will not make a difference. However I paid for half of the funeral expences, and my stepmother has two urns am I at least entitled to one of the two urns?

Thank you for your help. Thats all I need to know at this point. I will however do the right thing and put my father to rest (were he wanted) next to his mother and father, some how some way. My stepmother would do anything to spite me!
