Was the police officer violating my rights? (leave in General Legal)
Sent to Legal Experts January 03 10:39 PM

Police want to me to charge a "grand theft auto" charge on someone who likely stole my vehicle. Even though this person is the prime suspect, I did not want to blindly and directly finger this person as the one who stole my vehicle because I did not witness this person taking my keys or the vehicle. I asked to file a "stolen vehicle report" and the initial officer on the case denied my request because it "is common sense that you know this guy took your car!", according to the officer. I waited until the next day to file a stolen vehicle report at the police station because of this officers conduct. Was this officer violating my rights? After all, I never actually saw this person take my car and no one at all had permission to drive my vehicle. Also, I feel they were trying to manipulate my speech patterns when doing the report. I also feel the officers were trying to place liability on me if the person was found innocent. Am I in the right in all of this? After all, I am being truthfu

Already Tried:
I filed a "stolen vehicle report". I cannot get my report until a detective closes the case. I just want to be more prepared when he comes to talk to me. I wish not to be manipulated.

Hi,

I understand that the police obviously tried to push you but GOOD FOR YOU...you stood your ground and did the right thing. You filed the report and will continue to say no more than that because, as you say, you did not see any particular person take the keys, drive the car, etc. No matter how many police question you, how many times, even if the DA talks with you....your position remains the same. If you continue to sense that anyone wants you to incriminate that particular person...stop them cold and say calmly "Look..I know what you're trying to make me say...but I am NEVER going to say it because I never saw him do thus and such...so please stop because it is becoming harrassment and if it continues I will stop talking with you. I have made my report and have told you all I know."

They are not actually violating your rights as such ...so far. And they cannot under any circumstances impose any kind of liability on you if the case against their 'favorite" defendant fails. Don't be concerned about that at all.
