question to ask upon hiring new employees

filling out job application can a employer ask for information about the status of an employee, dependability, attendance, punctuality, and quality of work from the employee former job, when the employee does not want them to know they are looking for another job. The only question I was told that they can ask is: would you rehir, reason for leaving, and dates of employment. Is this true or not. What is legal and illegal question.
