I am looking for legal help on a vehicle I purchased ...

I am looking for legal help on a vehicle I purchased on line out of Alton Il. The car was advertised as being in excellent condition but when I received the car the adsvertised expensive sound system had been removed and replaced with a broken AM radio. I have taken the car to an authorized PA state inspection rep. and he has indicated that the car would need thousands of dollars in repair just to pass inspection. Most of all I paid the dealed on April 11, 2008 the total amount of $12,900.00 and as of today I have not received a title or bill of sale. I have made several requests to the salesperson that I delt with to have the car returned for a full refund. I have even suggested that I be permitted to purchase a more expensive car. I have been turn down on all requests. As of today I had to purchase another car for work and now have no need for this unit. Do I have any rights in this matter as a consumer? I would like to file suit against the dealership if possible.

Already Tried:
I have made several attempts to contact the dealer by phone and email to have the problem resolved. I have also contacted my Attorny here in the Pittsburgh PA area where I live and he feels that action can be taken if I get no response from the dealer. I have contacted a Alton lawyer who does not handle such cases and said that I have the right to pursue legal action. He indicated that I get in touch with the IL Attorny General, which I did and they gave me this website to contact.

I live in the state of PA which does have a Lemon Law. What about the fact that I do not even have title to the vehicle?

I do have the initial contract for the cor that was faxed to me. I signed it and faxed it back. I do have a copy of this in my file. You indicated that I can came a lower amount. Is this amount in conjunction with the return of the car?

Les, it depends on what you would like to achieve. Would you like to force them to take the car back and give you all of your money back, plus any other money you have spent to get it inspected? This would be my suggestion. In that case, you can go to small claims court and demand an injunction for them to give the car back and return your money - but the limit is lower so you can't get it all back. That leaves you with the option of filing a normal suit for the entire amount.

Your other option is the try to keep the car and have them pay what is necessary to get it in the proper condition, and to give you the title. This is a more difficult path, and you will have to claim much more money - the cost of the car, plus all repairs needed, etc.

If you have a contract that was faxed to you, was it actually signed by the dealer, or did you just sign it and send it back? You will need the copy with their signature or you are out of luck.
