There is no legal basis. You can ask to approach the bench and that means all lawyers need to approach the bench when you have a procedural issue in which you do not want on the records or you do not want the jury to hear (if a jury trial). Asking to approach the bench is rare and not often granted by the Judge, especially if you are representing yourself.
