Sent to Legal Experts January 02 12:13 PM

Can I leagally give my unborn child the fathers last name? He passsed before the baby was born and he had wanted children prior to his death. I will be collecting social secruity for the child. I would love to give the baby his last name mainly because I want him to know who his family is on his fathers side and that is the only child that my boyfriend has fathered. We had also planned on getting married.

Hi,

Yes you can....there are no laws stating what you can or can not name your child. Either your name or his fathers is permissible.

So sorry to hear of your loss I wish you and your baby the best.

Walter

Reply to Walter's Post: Then why did the hospital say that I could legally not name my child his last name because of lawsuit reasons. Which really does not apply becuase he's dead and I am getting compensated or help with our child.
