Question

Do i have the right to speak up about he care company i worked for

Sent to Legal Experts September 03, 2006 6:52 p.m.

I was currently working for a care company now i was employed straight away last oct i sat my 1st aid course manual handling, health and hygiene 1+ 2. I was caring for people from all walks of life basically i had to pick things up along the way as it turned out i knom my vocation in life is to be a carer if i had any fault it was i cared too much. Every week a problem would crop up and time after time it was the same ones who kept the company afloat. I had to cover the country runwhile one lady from that area was on holiday. I started at 6.45am on sun5th aug travelled to Portpatrick from Stranraer to start my shift 7.00am -7.45 then onto Ardwell for 8.05am -8.50am,Sandhead for 9.00am -9.45am, the Drummore for 10.15am-11.15 then Ardwell for 11.30am-12.00 back to Sandhead 12.15-13.00 back to Drummore 1.30-2.00pm, Portlogan 2.15-2.45pm.then i got my first break by the time i got to Stranraer it was 3.30pm only to be back at Ardwell for 4.30pm - 5.00pm back to Sandhead for 5.30-6.15pm were my client there was ill she,s terminally ill with lung cancer i went and got her neighbours Mr+Mrs Allison then I phoned my head carer who has never met these clients i explained tht i would be running late and asked her to get cover for the gentleman at Portpatrick and lady at Leswalt she replied "can,t you rush them on" the people i care for are certainly not cattle and they are allowcated a time limit which i always stayed ny length whether it was half an hour or a hour! She then went on to say well we are short staffed forget about the lady at Leswalt just continue on. Back to Drummore for 6,46pm-7.30pm were my lady was on oxygen and in bed left her back to Ardwell just for my own piece of mind as Mrs M had been in tears earlier on, into S andhead 8.10-8.40pm still not to well it was a good job her friends came to help me which is totally a disgrace they even brought me some dinner as they knew how busy i had been. Then at 9.30-10.00pm i finally done my last client in Stranraer only tp get a text to see if i would go toCairnryan at 10.15pm i refused. I never got a contract so by the monday morbing i was fuming i phoned the office based in Newton Stewart that i would do the start of the country run then i was packing the job in, i bent over backwards working mostly every weekend the sunday the miles i had covered were 138 in one day. The only thing that kept me with the company was the clients but when your senior carer doesn,t know the country run and wasn,t prepared to do it i was so dishearted. At times they would phone me to get peoples telephone numbers the company is badly run they employ young girls they get ook out with another carer should what to do then basicly get on with it no induction taining or manual handling its all wrong. I learnt everything myself working at night studying and got no moe thanks for it. Then i was told that my senior carer was telling people i had been given the sack, 4 different people asked me thats making me look out bad so i,m going to solicitor to clear my name and thinking of phoning care commision peoplehave the right to be treated with respect and dignity. Do you think i should tell everything i know because i kept all my notes i feel its just a matter of time till something serious happens and i wouldn,t want it to be any of my family. I still want to remain a carer because i enjoy the hands on approach and intend to do various courses. Meatime i got my p45 and that was it! I was promised a bonus recieved nothing i was out from 7.30am and finishing at 10.45pm during the week my family life was falling apart i worked constantly with no day off what a mug i have been. What do you suggest i should do? Have i got the grounds to take them on legally? thanks Sheila McCulloch

Yes, you sound as though you do indeed have a good case for a claim of wrong dismissal. Go ahead and find a solicitor to help you. Also, go to this link for further UK laws to help you. You have rights and they sound as though they have breached the contract with you. Let me know if I may further assist you.
