Question

Real Estate Tax Law (Rights of only kin)

My wife’s father (who was never married) is deliquent with his property taxes in the tune of 62K. He has no other kin, and we are wondering if (or how) kin can pay the due taxes and take possesion of the property before it is auctioned by the state?? We live in Ramsey County, Minnesota. In addition, the land is free and clear with no mortgage.

You can pay his delinquent taxes, prior to auctioning, however, of my legal experience, that doesn't give you automatic right to ownership unless your wife's father deeds the propety over to you, by way of a quitclaim deed (or perhaps by way of warranty deed. LegalDocs : Warranty Deed Questionnaire) - your choice!
Or, you may wish to place a lien on the property to secure your investment if you so choose to pay. Or you can also have him sign a promissory note, allowing him so many days to pay you back.
