after i quit my job i kept getting paid. i was overpaid ...

after i quit my job i kept getting paid. i was overpaid about $3000. a few months later they wrote me a letter wanting the money back. is it legally mine since it was their mistake??

Unfortunately their mistake does not make it a right for you to keep it. The law only requires you to receive payments for actual monies earned as you did not earn the $3K, you can be charged with theft of the funds if you keep it. You are advised to speak with an attorney to further protect your interests, especially if you decide not to return the money and if the employer decides to press charges against you.

The best thing you can do is return the money and avoid legal reprocussions.

Reply to Lawyer, Broker 's Post: Do I have to pay it back even though I was the one who told them about the mistake and they didn't ask for the money until 3 months later. And also, they overpaid me $3000, but only asked for $2500. Is that a mistake or are they trying to appease me?

Thank you for your reply. Unfortunately as this is unearn money and they are making the request to return it, even after three months and even if their mistake, you should return it because they can have a legal cause of action against you.
