My question is... My husband's father past away this past Jan. 7, he had married a woman in Feb of 2005 that he was in the process of trying to get a annulment. To make a very long long story short, She had dropped him off at the hospital Nov. 16th and never returned to visit and moved 5 hours away to move in with one of her other Ex husbands. We have been having alot of dealings with her since. My husband has paid for all the funeral service, she still has not signed papers to hand the ashes over to my husband, so therefore his Father after weeks of being at the funeral home and not being cremated till she finally signed those papers is now cremated but at the funeral home waiting on her to sign papers to let my husband get his ashes. Anyway that is just a short story on what we are dealing with.
My question is Carl's father had took two loans out on two vehicles that upon his death were paid off per he had the death insurance. I have in front of me the Credit Unions copy of his Dad's accounts. It simply states that Carl J. Redford Jr (Son) is the beneficiary. The wife has gone to the Credit Union and first stated that the truck and car were bought after they were married, we have proved that this is not the case. As of yesterday the Credit Union has advised us to get a attorney cause they don't know who should get the titles of the vehicles. On none of these accounts does it list her name it just has My husband's father. The last vehicle he bought was a month before they got married. She has told the Credit Union she is entitled of both vehicles.
Does she have any rights?
It simply states on these papers in black and white this....
Upon the death of the last account owner, ownership of the account shall be divided equal among the surviving beneficiary listed below. The beneficiaries listed below are the beneficiaries of all the accounts listed under the ACCOUNT TYPE section on the reverse side. (This would be both of the vehicle accounts) Carl my husband is the only name in his Dad's writing.
How can the Credit Union hold these titles from my husband and tell him to get a attorney when It states it on their forms the rules? We are at lost and do not know what to do. All my husband wants is what is right and what his father wanted. We live in Alabama and to go back and forth as we have through this time is very costly, to hire a attorney is going to be outrages with the travel and loss of work on top of it.
Do you know what my husbands rights are and how we can get this rested? If you could please let me know as soon as you can what you feel needs to be done or if you have any information Law wise that you can copy to show us our rights that we might be able to send the Credit Union since they don't have a clue of what the law is.
