can the dea make you leave your home , to where you loose it because you cant make a payment. and your husband has court dates and he cant go, and you have children. do you have to leave or can you stay so you dont loose everything in your life

Okay, this one may not be the absolute best, so if you think it is not right please do not accept and relist your question, as no one else can answer this since I've started the thread.

First of all is the power that the DEA holds. If you are found with excessive drugs or paraphenalia in your home, the DEA upon search through a warrant can take your property. This can be your houses, cars, appliances, bank accounts, and any other major assets. They normally will not interfere with the stuff like clothing, food, etc.

Because the proceeds from drug sales is what is the normal route for purchasing these items, they will take them and auction them off. A typical year will contain about 4 DEA auctions per sector. These sectors are population based, so that they do not have to move and store anything they confiscate through warrants.

The fact that you have children creates a different scenario, because there are other agencies like Child Protective Agencies that can remove your children from the home. Because your husband is going to court, you could lose your kids. Him missing court opens up a whole other bunch of worms.

Since I believe this is not an open ended question, I would like to suggest that you immediately contact your local Department of Social Services and request help from them. They have many programs available to you that will help delay or prevent your children from being removed from the home.

Once the DEA or any other law enforcement agency confiscates your property, you give up that right to use said property. On the other hand if your husband is acquitted, the DEA must return that property to you, and you can then resume full use of it, at least until they figure a way to not double jeapordize, and bring in new charges which they can and probably will do if they felt they had a good case.

THANK YOU, BUT I ALREADY TALKED WITH THE FEDERAL ATTORNEY AND HE HAD ANSWERED IT FOR ME. NO I DONT HAVE TO MOVE. I WAS NEVER CHARGED. THE GUY WAS OUT SIDE MY HOUSE WITH THE DRUGS AND ANOTHER WAS IN MY HOUSE WITH 3000.00 ON HIM AND 1 BRAND NEW 1 INCH BONG NEVER USED. WAS IN THE BEDROOM. THEY SAID MY HOUSE WAS SO CLEAN AND NO OTHER STUFF WAS FOUND, THAT THEY COULD NOT EVEN CALL IT A DRUG HOUSE. BUT NOW ALL KINDS OF PEOPLE THAT HAVE BUSTED LATEKY ARE CALLING ME TO BUY DRUGS FROM ME, I DONT SELL DRUGS. ARE THEY TRYING TO SET ME UP NOW THAT I WENT ABOVE THERE HEADS TO THE FEDERAL ATTORNEY MYSELF AND PROVED THEM WRONGE?
