Question

Is it legal to use an "AKA".

My underage child wants to use my husband's last name. (He is actually the real father.) I want to change my child's last name to the same as mine using an aka.

Hello Customer (name blocked for privacy) and welcome to Just Answer.

How old is your son? Where would he be using the fictitious name (such a medical or school records)? Is there a reason you would prefer to use an AKA over a legal name change?

My son is 8 years old and willb e using that name at school and on medical records. Wish to go this route because it is quicker and less expensive. My sister did the same thing for her two children and they still use the aka as adults. Their legal papers such as a passport lists their legal name as well as their aka

Hello Customer (name blocked for privacy),

Yes, you may use an alias or fictitious name for your son. However, since it will not be a legal change, you will need to list his legal name as the primary on any documents in which the social security number must correspond to the name (such as his passport or future employment paperwork).
