Sent to Legal Experts October 24 05:12 PM

I have supplemental insurance through my employer. Today i received a letter in the mail, stating that my insurance coverage has been cancelled. My employer hasn't sent in the premiums. I have had the insurance for over a month and she has been taking the money out of my check. I have the check stub to prove it! what do I do??

Provide your employer with a written demand that all funds previously withheld from your checks be promptly either returned to you or remitted to the supplemental insurance carrier. If the money isn't returned promptly, you may have an action against your employer for conversion. The employer acts as a fiduciary when it withdraws amounts from your check. Sounds like your employer breached its duties as your fiduciary.
