My wife came to the US in 1955 when she was 5 years old with her parents on green cards. She is 56 years old. She is now in Federal prison serving a 35 month sentence for bank fraud and this is her first and only crime. She is now facing a hearing to see if she will be deported to Germany. My question is: Could she be deported?

Dear Balckjkjer,

If she has not applied for and received U.S. Citizenship, she can be determined by an immigration court as non-admissable and deported. Her residency status would be terminated. (withdrawan). The basis would be moral turpitude related to the crime or if the crime is considred a felony under federal or state regulations.
