My wife and her son came here on a fiance visa in ...

My wife and her son came here on a fiance visa in Feb 2007, we were married the same month. We are now looking at a divorce. My question is: Do I have to continue to support her under the Immigration law (Financial support form). Her green card is good for another 18 months and she does not want to go back to Russia.

Dear Jeff,

I feel sorry for your situation.

As you filed a petition for her and her son and likely presented affidavit of support - by completing and signing a document called an affidavit of support you accepted legal responsibility for financially supporting your wife and her son. This legally enforceable responsibility lasts until they become US citizens or can be credited with 40 quarters of work (usually 10 years),

As long as her permanent resident status is conditional - her status depends on your marriage and relations; and based on further USCIS approval.
