My nephew is currently living in mexico. He 10 years ago tried to bring drugs to the US , he got scared and turned back to mexico where he was arrested and sentenced to 10 years in prison. He was just released and our question is his green card expired on 8/25/2002. Can he still apply for a renewal and is he legally able to obtain it.

The permanent status in the US doesn't have expiration date. This status is granted indefinitely but the person has to maintain it.

If the green card holder was outside the US for more than a year without previous approval - his permanent resident status would be considered abandoned.

In your situation your nephew should apply for permanent residency again. because of complications - previous permanent status was abandoned and his sentencing - I strongly recommend to have an immigration attorney to handle his case.

Here is the most disturbing part of this question. His 6 year old niece who he has never met is dying of cancer and he is the only family member unable to come and show support and meet her once before she passes.
He would never do or try anything ilegal again so he would never try to cross withour a legal document. Could he safely and I said safely because his freedom is all he has at this time be able to request and get a permit to see his niece?
