I have made several purchases at macy's department ...

I have made several purchases at macy's department store using a check for all purchases. Many of the purchases I have returned for cash instead of a store credit. I then deposit the cash into my checking account. I have never bounced a check to Macy's and have covered all checks written. Today, when I was making a return at Macy's, their system had me "red flagged" and they would not issue me a cash return. Because of their denial, I will not have enough funds in my checking account to cover every check written. Would my recent activity with macy's be considered fraudulent?

It can possibly be construed as fraud (more specifically referred to as return fraud) as you have made several return for cash instead of store credit. Many stores such as Macy's look for possible identity theft or fraud, so after several repeated transaction they red flag the consumer for the consumer's protection and themselves. However, if your concern is whether you will be in any type of trouble, I highly doubt it as Macy's could have taken action to have you arrested if they believed you in fact committed a crime at the time.

Just for clarification, return fraud is a crime where a person using stolen identity attempts to return merchandise (typically stolen) in order to obtain the cash.

Reply to LawNinvest's Post: I will have several checks go through my bank from Macy's without adequate funds. If my bank does not cover these checks, several will be returned to Macy's totaling around $2,000. Each check was around $300 - $350. Will Macy's prosecute me or have me arrested? What will my bank do? I have never been in trouble with the law before. I am a 48 y/o divorced single mother trying to hold onto my house and make ends meet. I feel like I am in a desperate situation now with Macy's and my bank. Had they have issued me cash for my purchases, I would have had the money to deposit tomorrow. It has turned into a bad cycle that I started several weeks ago and have not been able to get out of. I am scared. Am I going to be in a lot of trouble?
