Sent to Legal Experts July 17, 2006 11:58 a.m.

I have a HIPAA question for which I cannot find an answer on the internet.

My employer’s health plan is requesting medical info from all staff, whether or not they belong to the plan. The info requested includes anyone with any serious ongoing condition such as: cancerous conditions, diabetes, heart and circulatory system conditions, high blood pressure, lung and respiratory conditions or AIDS, current pregnancies or any related illness. They even want this for my husband too.

I do not currently have my health plan with my employer. I am on with my husband.

Am Iegally required to provide this info to my employer for their health plan, even if I am not currently on this plan?

Thanks!

This is a very excellant question and despite finding information on the net regarding Hippa, it does not address if you are required to provide it to your employer. I suggest you contact your husband's insurance company and ask the advisor there. you might also contact your employer's insurance company and ask them.
