I am a Georgia resident and I received an email at both my home and corporate office (fortune 500 company) from a former friend who is currently involved in a bitter divorce proceeding. The email is apparently one of many sent to the ex-spouse which falsely accuses me of embezzlement and other similiar criminal activity. This is the first I have received directly, either at home or work. I am concerned this could impact my work status. I am also concerned about other written or verbal communications that may have been made in our community from the ex-spouse that will impact our me, my livlihood, my reputation or my family''s quality of life. What are my rights and what should I do?

If this person is making false written statements against you, you can sue for defamation. If they are also speaking these things you can sue for slander.

You should send them a cease and desist letter as soon as possible. You might also be able to get a cease and desist order, but this is hard to do, and can be costly.

The best option is to do the cease and desist, on an attorney's letterhead. We find that usually slows down the person who is making the false statements, and helps to build your defamation case by putting them on notice of the untruthfulness of their statements.

Get a good lawyer of your own ASAP.

3) Is this solely a tort action or can I claim a criminal act has been committed?
