Good Afternoon, my son was involved in an accident and was at fault. My insurance was the basic coverage in Florida 10/20. There were 4 people injured, and required medical attention. I know that my insurance coverage will not be enough to cover the medical expenses. Can they try and claim against my retirement or 401K account?

Hello,

Your 401K may be liable for a lawsuit but your retirement should be safe. In the end it is up to the judge to decide if either should be used in the judgment against you. The judge will look at all your assets, and income. Then he/she will decide what should be used to satisfy the judgment if anything.
