How can I obtain a copy of a complaint filed with the the Florida Adult Protective Services, DCYF? My aunt called me to Florida as she didn''t like the way her business was being handled by the neighbor next door whom she had given power of attorney for health care decisions. While I was in Florida someone filed a complaint that I was attempting to unduly influence my aunt. How do I get a copy of the complaint and have my name cleared. My aunt passed away.

Tried to get a copy of the complaint while my aunt was living from the Adult Protective Services , DCYF, Florida and they would not give it to me nor was I ever served any papers.

My sympathy to you for this situation. The complaints in these situations are almost always confidential by law as are the names of the complainants. If the investigation validated the complaint there is an administrative process for a hearing on the finding with Florida Adult Protective Services. I'm assuming that the compliant was invalidated if you received no notice of a valid finding and your appeal rights. More than likely this is a closed file because the complaint was invalidated. If so the best remedy is to let it go, it's sealed/confidential and in storage somewhere. Once the records retention period is reached it would be destroyed and the matter will be gone and forgotten. My research would indicate you should let the matter go away. Thanks for your question and I hope this gives you some information in the matter..
