(Not a Legal Question?)

Am I entitled to know what is on my husbands's 2006 tax retu

Sent to Legal Experts August 24 01:35 PM

I have been separated for two years from my husband. He showed up in court yesterday with only his 1099, not his tax return as was required by the court. For some reason, the judge relyed on his 1099 to use as his income. I am still married to the man. Am I entitled to know what is on his tax return, or if he even filed a tax return?

Unfortunately - no.

You may not legally obtain any tax information for the person without that person's consent. The form 2848 - http://www.irs.gov/pub/irs-pdf/f2848.pdf is used to provide you with rights to request tax information.

If you think that the income he provided is incorrect - you may file a motion with the court requesting re-assessment of the income.
