I am forwarding this question for my brother. Here is a summary and his question.
RE: MASS - CRIMINAL LAW QUESTION
Let me begin by thanking you for taking the time to answer my question. Please understand that I am incarerated and I am not financially able to pay for this service. I sincerely hope you will still be able to assist me with this urgent matter.
Summary: I had a Fugitive from Justice warrant from Florida. I signed an Extradition paper in 2005 while incarcerated for a year in MASS. The Judge gave Florida 3 months during that timeframe to pick me up. They never did. The warrant was dismissed with prejudice(in otherwords, they would be able to pick me up at a later date, so I'm not sure if that means it was with or without prejudice.) Now, in October 2007, I picked up an 18 month sentence in MASS and, at sentencing, I signed Extradition papers. So, the Judge gave me 18 months and an additional 3 months at the end of the 18 months, allowing Florida that time to pick me up. My question is: Should I be credited any time off my 5-year Florida sentence for time served in 2005 and also from the signing date of the Extradition papers in October 2007?
Also, what are the pros and cons pertaining to signing the Extradition papers? I'm not sure if I did the correct thing.
Thank you so much for your anticipated assistance with this matter. May you and your family have a most Blessed Holiday Season.
Sincerely,
John
