I have someone who has defaulted on the

I have someone who has defaulted on the promissory note he had signed. He has not paid for over 2 months and if I were to take him to small claims court, what would happen if the court sided with me? What if he still decides on not paying? What would the courts do?

If the court sided with you, it would award you a judgment for the amount due, plus your court costs, and post-judgment interest.

You could then be given a writ of execution, which would allow you to have enough of his assets seized and sold to satisfy your judgment.

Reply to Winston Mortain's Post: What factors would prevent them from siding with the defendant? I had the promissory note notarized and he's been failing to make recent payments and I'm thinking of taking him to court. What would happen if he ignored the courts and decided not to pay?
