I have received a suit summons on my company. I am a sole proprierty company. If I file for an LLC corporation will it protect my personal assets since the papers have been filed but not went to court?

No. If the actions giving rise to the lawshuit occurred while unincorporated, it would provide no protection. Also, it would depend on whether the negligence or breach claimed was based on the business operation or if there was any personal guarantee.

Chances of now seeking a hield behind a corporate wall is unlikely.
