My husband voluntarily left his job at the end of July. We never received notice of cancellation of benefits, nor did we receive cobra information. Now, our new insurance has kicked in, and our son is getting surgery next week. I had to contact my husband's previous employer to find out what was going on, and they said insurance was cancelled after July 31, but we were never informed because the corporate office was not aware that he no longer worked there. Isn't the company obligated to inform you that your insurance is cancelled in a timely manner?

We never received any cobra information, or any information at all for that matter, but now they say they will send us the Cobra paperwork and we can be covered for Aug-Sept if we pay the monthly premiums, which we just learned the price of. Had we known the expense, we may have chosen a different insurance route for the past 2 months. Is it ok that they are doing this, or should they have informed us within 14 days of termination?

They should have informed you within 14 days, but the remedy you for them to cover you for Aug and Sept under COBRA at the cost of that coverage is reasonable. You can sue them for violating the 14 day requirement thereby causing you damages of a higher COBRA rate than if you have sought insurance elsewhere if you had known sooner of the COBRA cost. But you have to take into consideration, how much cheaper could you have gotten insurance for, the amount of time and the money it would take to sue before you win a judgment for the damages.
